Court grants Athletics Kenya 30 days stay order

Athletics Kenya has been given a 30 days reprieve after the Milimani Law Court Judge Lawrence Mugambi gave the stay order on Friday 08, 2024.  

AK have 30 days to comply with his judgment pronounced yesterday ordering the current office bearers to vacate the office, declared them ineligible to vie in the fourth coming elections having served two terms of eight years and also to amend the federation constitution.

“Upon this matter coming up for judgment on 7/03/2024 before Hon. Justice L.N Mugambi in the presence of counsel for the Petitioners and 1st Respondent; it is here by ordered; That stay of execution of 30 days is granted.  “The order sealed and issued on 7th March 2024 by Deputy Registrar of the Constitutional and Human Rights Division of the High Court of Kenya.

Athletics Kenya executive member Barnaba Korir while speaking at the Riadha House said that the ineligibility judgment caught them by surprise but they are studying the ruling with their legal team to seek on the way forward which might lead for them to appeal against the ruling.

“We respect the rule of law and we have a right to be heard. But we must be intentional not to jeopardize the federation. We have several continental events that are coming and we have to ensure that they are well coordinated and their athletes do not suffer “said Korir.

Korir said that they are ready for elections and are willing to be democratic about the process.  “Elections will come and go we are ready for the elections nobody can stay in a position forever. The court case delayed the election process because we had started the process from the regions and we were in the process of holding national elections before everything was put on hold by the court case,” The Nairobi Region chairman concluded.
